The European Court of Justice’s ruling in the English Premier League’s case against UK publican Karen Murphy made this month was a legally complex judgement and the implications for the sports television industry are unclear and will not become clear for some time. First, the UK’s High Court, which referred the case to Luxembourg has to provide a definitive verdict. Beyond that, much will depend on the behaviour of consumers across Europe – specifically whether they start to buy foreign pay-television services in large numbers.
TV Sports Markets has followed this long-running case in-depth since the High Court’s referral to the ECJ in July 2008, gauging opinion from top rights lawyers, broadcasters and rights-holders and examining the potential ramifications for both rights holders worldwide which generate revenues in Europe but also broadcasters which operate within the European area.
