Lawyers acting for Stretford, of Proactive Sports Management group (whose parent company is the Formation Group plc), have served papers on the FA.
Stretford, who could be suspended from continuing as a registered agent, claims that the disciplinary proceedings brought against him are in breach of natural justice and the European Convention on Human Rights.
Given that the tribunal empowered to hear the case is appointed by the FA - and consists mainly of FA councillors and officials - Stretford claims it cannot be of an independent and impartial nature and is therefore in breach of the European Convention.
BBC Sport reports that an FA spokesman totally refuted the claims and said the association was confident its procedures were fully compliant with all relevant laws.
The charges against Stretford were brought on June 17 and relate to alleged breaches of the FIFA players' agents regulations and FA rules, and to the circumstances surrounding how he acquired the right to represent Rooney.
They also relate to the evidence he provided in respect of a case heard at Warrington Crown Court in October 2004.
