A court date of February 23, 2004 has been set for the hearing although US District Court Judge James F. Holderman urged both sides to meet with US Magistrate Judge Sidney Schenkier to try to settle the dispute outside of the courtroom.
Initially filed on December 16 last year, the suit claims the so-called rooftop clubs 'unjustly enrich themselves to the tune of millions of dollars each year' by selling seats with views of the field from buildings outside the stadium, while the Cubs get 'absolutely nothing'.
The team has said the rooftops, which have been licensed by the city as entertainment establishments since 1998, generate close to $7million in annual revenue and believes that the rooftop owners should pay the Cubs $3m annually for the facility.
A date has been set for the Chicago Cubs' lawsuit against the owners of nine members' clubs whose patrons watch the team's baseball games from rooftops across the street from the Wrigley Field stadium.
