LEGAL VIEWS ON PREMIER LEAGUE RIGHTS VICTORY

A leading legal expert in London says the decision to rule in favour of the Premier League's en bloc sale of exclusive broadcast rights is 'out of line' with those made in Europe on the same collective selling issue.

Warren Phelops, partner and head of the sports group at City law firm Nicholson Graham & Jones said: "In Spain and Germany clubs have been supported in selling TV on an individual basis.
"However, the English court has had the benefit of seeing the results of individual selling in these countries where club cartels could well be replaced by television cartels as a result of the necessity to determine issues such as fixture schedules.
"Until now collective selling of broadcasting rights has been dealt with under national laws in European countries. However, the European Commission's appetite to investigate sporting arrangments is on the increase and it is already investigating collective selling arrangements in motor sport. Therefore with the disparity of approaches on this issue across Europe I would not bet against the Commission looking at this issue as well in the future.
"At the moment a victory for the football industry and a defeat for the television industry, but watch this space."
